Child Support & Private Education/Private Health Insurance

Okay so Mr Wonderful is refusing to enter into a private child support agreement. He states that it wasn't a dual agreement to send our children to a private school. The youngest children all began attending the school that they are in during the marriage. My son is almost 10 & began at this school in prep and the two girls began at preschool level.

To do claim extra child support I will need to do this through the CSA. So that's fine that's what I will do.

Can I claim back pay for this considering they have always been at this school?

My children and myself have always been privately health insured. Is this claimable as well?

I cannot quite believe how some people are just not up for paying what is fair and reasonable... Does my head in... :wall:

Inanna do you have a private agreement on what he should contribute to for the children? If he isn't paying his share would you consider having him assessed for what CS says he should pay? That might give you an idea of what you and your children are entitled to. Perhaps your not getting the amount of support financially that your entitled to. The amount my ex has been calculated to pay (and still doesn't even no the amount is increasing every month he doesn't pay) does not come close to covering DD's private schooling.
I guess if you have a private agreement ideally you want to keep it that way and agree to something that seems fair and reasonable for all parties involved. My ex currently has to pay $40 a month (it use to be $400) but my friend who has one DD ex's pays her $1000 a month. For both of us we have elected for CS to collect payments due to the other parties not following through with past arrangements.

It does my head in also. My ex has paid around $1000 in 8.5years. The debt is obviously a very large amount now. Its horrid that if they can get out of it they will (well a large percent don't want to discriminate as a large amount of people do do the right thing)

My situation is a little bit different Mildez. Where a child/ren were already in private schooling then "special circumstances" can be claimed.
So I will make an application to do this.

However, I am not sure if that extends to private health insurance?

I also get CSA to collect on my behalf - it makes it much easier...

Oh I didn't realise you could. Perhaps I could then also however I wouldn't seeing as I haven't received anything anyhow and under the circumstances. Sorry I could not be of any help to you Ianna. You have helped me out alot in the past. Hope you get some more support for this.

The problem with a private agreement is that if the other parent does not comply with the agreement you need to go back to Court to get paid... Obviously non compliant "other parent" is not a good deal to enter into a private agreement with...

I have no idea, but Id like to think that if you have always had PHI then it could continue.
I'm assuming it was family cover or was t just you and the children?
