Help- been given $1400 excess water bill. Can this go on bankruptcy?

Hi lovely people,

I'm in a bit of a mess, a while ago we were given a $1400 excess water bill from our real estate that dates back from August 2009 to March 2010. We are really really certain that we haven't used the water, but also know that this is a fight neither myself or my DF have the heart for at the moment with so much else going on.

I'm wondering if anyone knows whether a water bill can be included in bankruptcy. We are planning to file for bankruptcy in July and I'm not sure whether I can do this. Any advice would be great.

Any bill that is in your name and owing at the time of filing is able to be included in your file.......but by memory of previous posts - are you sure this is the road you are prepared to take?

Yeah it can be as long as it was incurred before the bankruptcy is filed (which it has obviously). However, who do you owe the money to? The real estate agent or the water authority as the ramifications could differ, ie water authority might not let you have an account in your name or real estate might not renew lease so I would check first.

Before going into bankrupty think very seriously. i am in a part 9 debt agreement that is part of the bankruptcy act but you are not backrupt. what they do is freeze all the interest and apply to your creditors for a reduction in the total. ie. they will offer them 60c for every dollar you owe them. you then pay this back over 5 years with no interest and no harrasing calls. take my advise and stay away from FOX SYMES and Ass as they screwed me over. Mine is with Credit Repair Australia and they are great. Give them a call and discuss your options. dont declare yourself as insolvant unless its a last resort. You have to declare that to real estates if you rent al all sorts, The debt agreement you dont. you just cant get anything on a contract like credit or mobile phones.

Yeah we're pretty sure this is the path we need to take, we've been to a couple of financial counselors and its just the best option for us with little ones, DF on a low income and me at uni for the next 18 months minimum. I know its a big decision but I also know that there is life after bankruptcy! lol

Yup Ella there sure if a life after bankrupsy. And people do it everyday!!! Not a big deal at all, expecially since you are not planning on buying a new house etc during the time it effects your credit rating for! PLenty of people borrow moneies for cars loans etc when the rules have been lifted!! Good job for doing something about it now rather then later..

And yes the water bill can go under that umbrella as well.
