VCAT

We are taking our landlord (who is DHs mother) to vcat for compensation of rent due to her reclaiming over half our land for over 2 years without the real estates knowledge.
We also have been given 120 days notice since making the RE aware of this.
Now the RE have got there backs up and we lose our good reference as taking her = taking them, which is totally unfair as she did it behind there back we have no issue with the RE.
DH wont back out of VCAT and really we shouldnt be guilt tripped into backing out but we dont have long to find a new house and could do with the RE on side with us as it was the landlords fault not theres :( everything is a huge mess

:-( I can only hope that the next house you apply for you can expain the situation to the RE agent and they will be compasionate. I still can't believe your MIL is doing this ((hugs))

That's what I was going to say too, they'll want to know why you didn't action this when it originally happened I'd say.

Our solicitor has a number of reasons why:
We have changed property manager 6 times in 30 months so constantly playing catch up
Everytime a problem was presented we were just told well you need to have a word with your mum RE constantly palmed it off
RE were notified 6 months ago, took them 6 months to tell her she needed to give land back
Still waiting for urgent repairs 22 months since applying for them so lost hope of getting anywhere
and most importantly wanted to keep a roof over our kids heads so didnt want to cause trouble now we have been kicked out what are we losing?

Could you talk to the RE agency again and explain what you have here - that your issue is with your MIL and that you would really appreciate a good reference particularly as you need to provide housing for your children. Appeal to their better nature. Are they part of a chain at all - can you go higher than the person you've already dealt with?

I would think that they could at the very least provide you with a letter that outlines the facts ie. that you've always paid rent on time, no damage to the property etc.

If you can't get a reference, then I'd just be honest with your next application and say that your previous landlord was your MIL and that there's been a falling out over family issues.

ive tried but they still see it as taking them which is why its on a backburner suggested by our solicitor so we still get the good reference they are giving us.
They dont do written references anymore so we need them til we get a house, as we arent contesting the actual vacate notice we arent bound by days as such
