Renting- Advice on getting an oven fixed

My Oven broke I let the real estate know 1.5mnths ago including a written letter, the following week they sent a man to repair the oven he told me that the element and the fan had stopped working and it wasn't worth fixing cheaper to replace.
He told the real estate then told me that they would notify the owner 'but he wouldn't be happy'
Was then told the owner was on holidays for a week- so waited a week
Rang back and realestate says happily the owner has agreed to replace the oven :clap: ummmmm did they think i was going to pay???
Next step they were sending over someone to measure didnt show up, rang the realestate and now the measurer is holidaying??????
I have rang every second day since and the real estate says that they are waiting on the guy to measure then order and fit the oven.

So I'm thinking i'm going to stop paying rent or at least take one weeks rent and measure, buy an oven myself??? How much trouble would i get in could I get a bad rental history?
Or should I threaten that I wont be paying if it doesn't get fixed in two weeks

call the tenancy tribunal and get them involved. That is absolutely ridiculous.

Call the tribunal. Don't try fix things yourself.

Definitely look into getting the tribunal involved, you may be entitled to reasonable rent reduction for the time you have been without.

There should be a Tenancy Advocacy Service in you region (try google), they offer free advice and assistance and handle matter like this all the time. Get in touch with them ASAP. The other thing to do is contact your REA and tell them that if they don't get this issue fixed ASAP, you will take the matter to tribunal - that usually scared them enough to pull their act together.

I would also check your lease agreement and see what it says about repairs and if this is classed as an emergency repair as there are time frames that things need to be fixed by.

what ever you do, dont stop paying your rent. This happened to my brother after he rented a house that was being renovated. They promised to have the reno's done within a couple of weeks (obviously tax purposes) and 12 months down the track it still wasnt done. He took matters into his own hands and stopped paying rent and then got threatened with court for unpaid rent. They settled out of court, but my brother ended up with no house after he was evicted.

I'd be calling the RTA. I believe they have 7 days to do repairs (Could be wrong though). An oven is an important thing to not be fixed/replaced!

Call the tenancies tribunal and get advice on how to proceed. Whatever you do, DO NOT STOP PAYING RENT! Even though they are doing the wrong thing, you can still be evicted for it. The tribunal could very well rule that you get that period of time rent free, as cooking is obviously considered essential and something you should not be without. There should be a condition within the lease that states if something is not seen to in a reasonable amount of time, you are then entitled to get it done yourself and be reimbursed, but who knows how long that could be. Get advice from the tribunal and go that way, so your butt is totally covered.

That is absolutely sheer laziness!! How can they get away with it!? We have been waiting months for our back fence to be fixed. A whole section has fallen and we also have 2 dogs. We have to prop up heavy objects against it so our dogs don't get out. It's downright lazy! :angry:

Sorry, I'm just sick of renters being taken for a ride! Just because we don't have the money to buy yet doesn't mean we don't need basic amenities! But yes, I would contact the tribunal :)

I would be contacting the tribunal, CC'ing the real estate agent and offering them their advice on the available solutions (1. buying the oven in lieu of rent; 2. breaking the lease no penalty; 3. legal action). The way I understand it, you would be able to break the lease no penalty - but then again, it may be what the owner is actually wanting.

As for whether the owner is happy or not, tough titties. you have a contract, it works both ways.
