We moved to a new place in July. 3 weeks after we moved (we rent) the owner decides to sell grrrr.
Now our life is on display for anyone to see and it infuriates me!!
We started with an open every weekend for a month, now it's every 2 weeks and they are asking us to let people through on days I'm off work. (single sets of people).
I've had enough now. I won't put my treasured photos up and won't finish unpacking because there's no point and besides that I don't want strangers looking at our photos (maybe I'm weird).
So how much is too much, when can I say no??
AND our gas stove has been going out and running just gas since we moved in- still no one has fixed it, our heat lamp WE had to get a contractor from work to look at it because we are STILL waiting on someone to come. Turns out it burnt a hole in the circuit and we were lucky not to have a fire start!
I want out of this place now, can we break lease safely?? Without a black mark?
Same thing happened to us. basically the length of ur leases it is your house. You have the complete right to say no. they cant make you have open houses.
Say to them. these days for this many hours you will let them have an open house and do what suits you if they dont like it they will just have to wait til your lease runs out.
Im not sure what the rules are in VIC but here in Qld we can break our lease for ANY reason but we have to pay a let me (1 week rent + GST) and rent until a new tenant is found. In the case that the property is for sale I would tell the real estate that is what you are going to do and see if they can come to an arrangement with the owner on a finalisation date. They might find it easier to sell without tenants in it. But they can not expect you to pay until a new tenant is found if they arent going to retenant t. Hope that makes sense. I would also say to call your rental authority too and see what they say.
In Victoria an agent has the right to as many open for inspections as they like but they do need to give you 24 hours written notice. The inspections must be after 8am and before 6pm and not on Sundays or public holidays.

You know what I would do? Contact the real estate agent, make them aware you are highly negotiable in terms of ending the lease. It might help you both out (you and the seller) if someone wants an empty house. However, since he got your lease and then put it on the market, it sounds as though he thought it was an advantage to have renters in when he tried to sell it, so perhaps you won't be too lucky asking for a break lease. Best of luck with it all, house inspections suck.
Maybe if you ask the agent to fix all your issues while they are trying to show people around they will either stop bringing people at crazy times or fix them.
Your lease also says something about enjoying your property and not being disturbed by others. Or something like that. I'd call YOUR agent (likely to be different to the person selling the house) and explain that whilst you are willing to be flexible and accommodating, it is now becoming an intrusion and therefore you would like to limit it to x number of opens per week/month.
I do feel your pain. Our landlord sold last year and it was a nightmare. We took all photos down too and were told we couldn't be here for opens!!!! I was furious and lodged a complaint after they broke dd's toys. I hated the whole process from the photographer telling me I should have bought flowers for the house and breaking something in my bathroom (and trying to cover it up) to people hovering around our property, people actually entering our yard at random times!, not even being told the house had sold... You have my sympathies
I spoke to consumer affairs today. We cant break lease which ideally I want.
We offered an agreed end of lease should the house sell but haven't been thanked in any way!!!
Yes renting agent is different to selling agent which is frustrating.
I spoke to dh- I have uni exams coming up, birthdays, I'm pregnant and about to take on an extra day at work. I told him bluntly that they can have one more open this month then they can have one in november and December if the house is not sold by January we are going to look further into safely breaking the lease or if the things are fixed we MAY make an offer - about $30k less than he wants though.
CA were pretty useless though. They told me not to allow any more opens and if we got taken to tribunal because they already had 6 plus 2 private opens we would likely be looked in favor.
They also said to fix the urgent repairs including replacing the benchtop stove completely then to serve a 14 day notice to the leasing agent. If not paid to take them to tribunal.
But I don't really want to do any of that I want OUT!!! lol
Thanks for all the advice girls- this is so I comfortable. My dd doesn't understand so I take her out everytime. They had 9 yes 9 agents come at one time to look at the place and dd was distraught screaming at them to get out of her room.
If they aren't going to be reasonable, maybe you could "help" them come to the conclusion that they would be better off letting you out of your lease. Nothing like a home open when the beds are unmade, sink full of dirty dishes and dirty dog prints through the family room!
