    Unsigned amendment to contract - sick leave

    My original contract states we can be off for up to 5 days without a drs cert but the new GM issued a memo a few months ago with some general changes to hours etc and now we can only take 2 days off before we need a drs cert.

    I was off sick thurs and fri and don't feel up to going back to work tomorrow but I can't get in to see my dr till Wednesday.

    Can my employer enforce the new 2 days off rule without my having signed the memo?

    if you've been notified of the requirement, yes, i believe they can. you're aware of the change, so you can't say you didn't know. requirements change all the time, and you may find he sent it via email and kept a copy of read receipts from those emails to show you're aware of it.

    Thanks BG - I thought that might be the case.

    Will Drs here backdate a certificate? I've only ever had to see a Dr in England for sick certs so I don't know how it works here.

    some doctors might, but i wouldn't think they'd backdate that far.... may be worth trying to get into another dr tomorrow if you can. My GP wouldn't at all, but I've been to another guy, who gave it to me for the tuesday, when I saw him wednesday - but he was giving me the rest of the week off as well....

    by wed - the dr couldn't really tell what you had been like the previous thurs - that's almost a week away sorry, I think it's a no no...

    but I DO hope you feel better soon - make sure you look after yourself.

    FWIW, I usually go to the dr on the 2nd day I'm off regardless, cause I figure if I'm sick enough to stay home for two days in a row, I;m sick enough to go to the Dr.

    most gps wont backdate a med certificate as they can't prove you were sick on the day in question.

    My employer accepts a Stat Dec in lieu of a medical certificate. Not sure whether that's universal practice but worth checking? Sometimes you are ill enough to stay home for a couple of days but don't need to see a doctor. Gastro is a good example. No point spreading your germs around a GP's waiting room just for the purpose of obtaining a medical certificate!

    oh yes! I heard about this at my work recently too!! but I work for the govt so.... maybe different conditions at private companies...
