Question about business & confidential data base information

Can anyone tell me - if a person is running a business & collects your personal information, then years later starts a new business - are they still able to transfer the old business data base to the new business? Or is that a confidential information breech?

If it was a proper company, I wouldn't think so, because you've given it to a particular company. However if it's a party plan type thing, it probably shouldn't be done but I don't know how you'd stop it, y'know? A bit sneaky

Given that it's years later I would say no. If a business is sold or change hands then that would be acceptable but not after a long time but it's difficult to control really.

Same type of business, just rebranded due to the old one having little trade, but still theoretically active? Yes, but not great.

Otherwise, was there the "no third parties" tick box? Did you tick it? Loopholery, I know, but that's how they make money.
