    Divorce - where do I start?

    My XDH and I have been seperated since November 07. How do I get a divorce, how much does it cost, where do I even begin?

    There will be no property settlement or custody battle, just a clean we-want-the-marriage-to-be-over type of deal.

    HELP!!!!

    you can do it yourself . there is some papers to fill out but its not hard . you can get divorce papers from leqal aid , some lawyers who do divorce will help you with papers . even family law courts should have the papers. once you fill them out , with no property or children it will go through no problems .you then have to lodge them and get them served on xdh , as a private investigator my opinion is , have them serve on him by a sheriff or commerical agent that way he cant say he wasnt serve with any papers, the person who serves the papers has to write down what time date where they where served at and what xdh said about when he got papers , hopes this help s you , good luck

    Yep i did this altho me and EX was on talking ground we had no property or children custody disputes witch made it easy we sat own filled them out and paid for it cost about 200 i think from memory. It really wasn't that hard.

    YOu can print the papers off the net actually

    and if you are on a concession card and you file yourself then its completly free.

    If it is an amicable divorce and both parties are willing to sign without serving papers you can preint the documents off the net and take them in.

    I think mione cost $40 or something like that to lodge as we co-signed and had worked out the settlement ourselves.

    I just called and got an Application for Divorce kit sent out. The lady on the phone said it would be $432 but it says on the net if I hold a concession card it will be free. Yay!

    Thank you so much, looks like it's not a difficult process and no need for lawyers. Thank god!

    You know *cough cough* if your ex-partner wants the divorce as much as you - you can just.. umm... fudge the date of separation *whistles*

    My exH and I separated in February 2004 - but we put the date as being November 2003 so we could apply 3 months quicker.. heehee!!!

    If you are both in agreeance - and both sign the docs as separated that date - the Court doesn't know exactly when it was from. We just wanted it done as quick as possible (which was good cos divorce was granted in April 2005 and I got remarried that same year!)

    Anyhoo.. just something to think about... all hush hush of course..

    Arimeh- i cant do that cause of centrelink.. im on the single parent pension so they have record of my date of seperation

    I just did my divorce kit last week. It was really easy.

    If you need to get an affadavit done the easiest place to go is the local cop shop.

    You can also do the whole thing by post which is what I'm doing. I only mailed my application in to the court last Monday and by Friday I had a court date so it's a really quick service.

    I'm now serving my ex by certified mail & hoping that re signs the form he needs to sign & returns it to me. If not nothing's lost as cos I've got a health care card it's cost me nothing.

    I've got my kit all filled out, once the date I can apply comes around, I'm off to the court to get the date, I have a friend who's hubby is a process server so he will track xh down (NFI where he is living & honestly don't care as long as he keeps the fark away from me) to serve him the papers.

    I'm just hoping there isn't a wait for the date.
