Just after advice - where do I go? Who do I talk to? (NSW)
My 17yo son has been working after school/weekends for a local takeaway shop (won't go into details as to what type).
When he first started (on trial) he was paid cash in hand, about 2 months ago, he went "on the books", firstly because that's how it should be done, and secondly for more job security (or so he thought).
He started off with about 4-5 shifts per week (this is on top of studying for his HSC). He would often get called in if someone was not available. They have rostered him on the 6 evenings they are open over the last few weeks. Last week I spoke to the manager and said this was too much on top of studying, to try to only roster him on 4 shifts. These shifts start anywhere from 4.30pm to 11pm - so they are quite long (he has to get up the next morning for school at 7am. No meal breaks, one free "meal" per week (value of about $10), discounted drinks while working.
The problem is the "owner" has not paid him for week before last so currently he is now owed 2 weeks pay. As far as I can gather, no one has been paid (this includes the manager). The owner is interstate and the manager has a number where she can contact him in emergencies only. The majority of the staff are "paid in the hand". (I think to avoid this problem.)
My son doesn't know when he is rostered on next - hasn't received a message back from the manager. I really don't want him working without getting paid, so I'm not pushing for him to go in. I'd prefer he went and worked somewhere that pay is more reliable.
BTW - This person owns 2 shops that I know of (not sure it makes any difference - but I wonder if employees in the other shop are getting their pay
