How long does an employer have to pay you your final pay if you resign
i resigned, they cant offer me part time work so i had to resign... after weeks of negotiation they agreed that if i resign they would give me 5.25 weeks full pay plus my entitlements..
its a long story but i feel like they pressured me into quiting... but anyway i have and they are giving me the 5.25 weeks in lieu of notice but the payroll girl says i wont get the money until next pay cycle wed fornight.....
I cant find anywhere anything about a time limit they have to pay me... does anyone know if there is one.
I live in south australia - head office is canberra
Yeah I think it's next pay day you have to wait to get your final wages. Hopefully some girls who know what they're talking about will pop in and help out, but from my experience with DH resigning, he's waited until the next pay day to get what's owed to him.
We always processed on the day any immediate resignation, redundancy or termination. So they received their final pay the next day (not dodgy, just practicalities of bank transfers). This was instructed by HR, so I assume there was a requirement for it, this was before all the changes Howard did though.
I used to do payroll and I was always told by the bosses not to process final pays until the next pay run, instead of doing one especially. DH's work does the same thing. I guess that's fair enough if you get paid weekly or fortnightly, but if you get paid monthly, then surely they can do a seperate transaction
