We moved into our rental 8wks ago. since moving in we have had many issues with it. afew have been fixed up but one in particular. The house is full of spiders and ants. I've woken up to find spiders on my newborn, have had them drop from within the rangehood while ive got our dinner cooking. The ants are everywhere. i have video footage of them the entire way around my middle childs bedroom, in the kitchen, pantry, cupboards. We have to wash out the bath daily before use to remove the ants and spiders that are in there.
I emailed the realestate and it took them over a week to get back to us with saying they will contact owner and request pest control. In my email i asked if they could get the company back that done it before we moved in under the warrenty. Received an email today(3weeks after i notified them of the situation) and the owner has declined to pest control at this time.
It states in my lease that it is the owners responsibility to pest control when needed. Now i feel going by the information from the RE that it was never done before we moved in as if it was it would be as simple as calling company and getting it done under the warrenty instead of requesting it to be done via the owner.
Would you breach the real estate( i have video and photographs of both ants and spiders) and risk not getting lease renewed or just leave it and get it done ourselves and fight them when we eventually move out (i refuse to do it when we leave)
I would give the breach - that's unacceptable. The pest infestation makes the place uninhabitable. Contact your tenancy tribunal in your state for advice.
Write them a letter and ask to provide evidence of when it was last done or you will be doing the breach. there is no point doing anything after you are leaving as they will just take it from your bond so best to do something now.
Pest Control isn't the owners responsibility under the Act, however if it states it in your lease, than it is the owners responsibility. Pest Control can help with the removal of spiders, however ants are very hard to get rid of. Many pest controllers won't even treat for removal of ants as it does not work.
ETA: I forgot to say that definitely send out a NTR. As it's in the lease, they've kind of put their foot in it, and have to get it done now.
