Hello, just looking for some clarification if someone can help me.
My XP put in as estimate in aug of $14000. He did the same in 2008, and then earnt $88000. CSA tells me that they DO NOT backdate for the financial year, they just go off the estimate until a new income amount comes in.
But on their front page it says: " At the end of your child support period and your estimate period, CSA is required to verify the accuracy of your estimate. We may conduct our own investigations, including asking you to provide proof of your income.
If CSA determines that you have under-estimated your income, we must recalculate your child support assessment based on your actual income. This will create arrears that you will be required to pay. A penalty will also be applied to any additional child support payable if your actual income is at least 10 per cent higher than your estimate. "
As far as I know, they take his income from the ATO from last financial year, when he put his tax return in, work out what his payments would be from that & thats what he is to pay this financial year unless he disputes it & gets it dropped. I got them to drop it for DH when we were seperated, but that was my decision. Not sure if they can do it themselves.
If he doesn't pay you enough, as far as I know, when he puts his tax in & they see the amount he actually earnt they can take his tax pay out & give it to you. I think you need CSA to be collecting for that though, not a private arrangement.
Thanks for the replies. Spent 45 mins on the phone to CSA, and I am applying for a change of assessment. The person I spoke to said given his history (he has done this for the last 4 years), they will most likely give hm a 'set income'.
I also have to lodge an objection to his estimate on Aug 25, along with a request for an extension of objection given it is more than 28 days.
I also have to ASK them to reconcile the accounts.
