ive had big dramas with the landlord and his sales agent, i have requested to my rentals agent that my bond be returned and the lease riped up she was looking into it and going to get the owner to agree, but had been having trouble getting in contact with him, as it was a few days befor imy seccond months rent was due, i was advised to hold it untill hearing back. this was over a week ago now, my rents due the 16th each month, the one i need to speak to is very busy and hard to catch in the office, i have spoke to the consumer affairs place, as i have not had "peacefull enjoyment of the property" it is fair grounds for a mutual lease termination, but do i wait a little longer, and be late with rent if i cant get out just yet, or do i pay it and if i end up getting out, wait for them to return the unused amount? if they can? renting, AGGHH
can you pay a week or two rather than a full month? the last thing you want is to have a "not paying" strike against your name - i'm guessing if you're there, you'll need to pay for that time, so it's best to pay for the period you have been there kwim?
i would be on the phone constantly trying to get a resolution to this hun
A real estate agents CANNOT terminate a lease for you. You need to go to the rental tribunal in your state and prove that you haven't had " quiet enjoyment" and the tribunal can return your bond, AFTER you vacate.
You will NOT get the bond back until you vacate regardless of the circumstances
The lease also cannot be terminated on agreement of the tenants, real estate. Or landlord.
Lodge your application with the tribunal asap and PAY ALL your rent up to date or when you go to the tribunal they will not even hear the case. You NEED to be ahead in your rent as stated on the lease, ( either two weeks AHEAD at all times or more)
If you need any more specific info pm me, I'm sure melba is different to Sydney but only in terms of what the tribunal is actually called. Is is VCAT? Or something similar? It's been a while since i rented in melba.

:yeahthat: I've done part of my real estate cert (I must finish it!!) and thats what we learnt, ring VCAT today and pay your rent today too, its not written down i presume the real estate saying to hold off on paying so they could very easily turn around and say we never said that and you'll be in a lot of trouble well not so much trouble but have struggles finding another property
