    Workplace Bullying Q

    Short and simple, can you sue an employer for workplace bullying?

    Not sure about 'suing' but I know an employee on Workcover claiming harassment against her employer. I know there are legal people involved on both sides but not sure if the employer is actually being sued (not wanting to get too involved and all!).

    Pretty much - some of the questions you are likely to be asked is how you've tried to address the issue prior to taking legal action. What the results/response was, and how long things have been going on.

    I'd suggest talking to the Industrial Relations ombudsman or Fair Work if you haven't already. Also keeping records of incidents and also discussions you've had with management etc to support your case.

    Yes I agree with Sunshine. The company should have had a policy and procedure on bullying and I would think that would have had to be followed. If it was and the bullying continued, then I would think you would be able to.
