i think you are exempt from paying rent during the time but you do have to pay for your alternative accom. have pm'ed you a copy of the rental guide from consumer affairs vic.

I had my opportunity to speak with the tenancy tribunal today regarding an issue I am having but was on hold for 30 mins and by then my 2 DD's had awoken from their slumber...so my chance has gone until I don't know when...LOL
Anyway, the landlords want to paint the entire house. We were made aware of this in April and we informed the landlords we would be expecting a baby in October and would be happy to have the painting done BEFORE October. So with 6 months up their sleeve to paint with no complaint from us, when do the choose to paint....NOW!A$$holes
I have managed to put them off 3 weeks...but that is all. The painting will take 7 days and the whole house is being painted.
So with a then to be 5-6 week old and 15month old DD, we see that we have no choice but to 'move out' for that period of time.
Now what I want to know is surely we are entitled to some kind of compensation for this considering even if we stayed we would not have access to essential amenities like the toilet, bathroom etc, not to mention the damage DD 15months could do to wet walls if we were here...and surely no-one would expect us to stay here with a newborn amongst all the paint fumes?
So, I'm not sure when I will get the chance to call the Tenancy board so until then I'm hoping someone here would know if we are infact entitled to something? I am definitely not going to speak to the real estate agent because he wouldn't be on our side anyway IYGWIM.
