    property split in Vic

    My bubs dad and I have split. We live in Vic. I will be selling the house as I can't afford to keep up with the payments on my own.

    Does anyone know for sure what entitlements he'd be in regard to my house?

    The house is in my name only. At one stage we both made payments towards the house from a joint account but since 16 or 17 months ago all payments have been made from my own account.

    We have been defacto on and off for 3 1/2 years. Our last split was 17 months ago & he has only been coninuously living in the house since 16 months ago.

    He thinks he'll get 50/50. I think not. Bub will be living with me.

    Does anyone know how it works, from experience.

    hun as you werent married it will goto civil court not family court and he will have to sue you for anything like that......my advice is to retain legal advice...my sister went through it with her de facto and it took over 2 years to get any money out of him even though she had paid the mortgage while they were together because it was in his name.

    Yep, Id get legal advice you can often get an initial consult for free, or ring legal aid - whichever party registers first gets it and the other party will be blocked.

    Unfortunatly you can't get Legal Aid on Property Matters, you can however ring a local community centre and they have free lawyers there to see on a particular night. The best option is to ring around and make an appointment with a solictor that will give you the first half hour for free, they will help you and not watch the clock, so you can walk away with clear answers that suit your particular circumstances.
