I have noted everything down that I could possibly remember. Contemporaneous notes they are called or something like that. The grounds I was asked to leave on was bullying and threats. Threats of what, I do not know, nor was I going to stay and find out. It is just added to my argument. Speaking to Fairwork Aust again yesterday, they said I could lodge a second General Protections complaint against him (because I have been outed for exercising my right to lodge a Fairwork Aust complaint against him), or basically just add it to the first issue since the two issues are interrelated, but to ask my legal team.

I could add it to the first one, which would start to amount to quite a list, but if it was on the second, penalties would be more severe if convicted in court for second and subsequent offences.... For example, if he had done this before and not been convicted, then the penalty wouldn't be very harsh ($ fine wise), but if he has been to court, tried and found guilty before, then the penalties go up.

I just read all of this and I feel sick for you. I was bullied at work once, it had a deep impact on me but I didn't fight it so good on you!


I'm so curious, though, about why you are concerned with keeping a low profile and not letting people know where you live. What's that about?

Sorry to have abandoned this thread for so long. I haven't had much internet or computer available of late. As it is, I am in the library on public 'puters!

Anyway, thank you all for your support and thoughts throughout this. All I can say is that the issue was not resolved through Fair Work Aust, but we did reach a settlement out of court.

If anyone is in a similar situation to me, or feels like they could be and may pursue things legally (or just feel things are going pear shaped at work as I did), KEEP NOTES on discussions, conversations, copies of emails, etc, etc, etc AS THEY HAPPEN (obviously you may not be able to stop work just to write notes, but do it on your lunch break/on the train on the way home/in the car around the corner from work, etc). This is for your eyes only, no one else at work. Make all of your notes as detailed as possible, with times, dates, body language, etc, as accurately as you remember them. From a legal standpoint, these "contemporaneous notes" can be very useful.

I found that to be very true, Netix, on two occasions with two different employers (one of which went to EOC and settled at mediation). Contemporaneous notes are gold, and so often much, much better than the arrogant self-assurance of power hungry bosses :hug:

Peanutter, I am reasonably happy with the outcome. I would have loved to also have stayed there, but it seemed that everyone had been turned against me, and it seemed the best thing to do. The settlement amount could have been better than anything I may have ended up with had I taken it to court, so all in all, I guess I need to say reasonably happy. That, and the lack of stress of having to go through the whole court process.
