DH wasn't paid one cent of super from his first two bosses and he was a full time employee with both. It was five years all up. He was advised to contact the ATO, so he did and they said they'd look into it. The result was that the first boss claimed bankrupcy and opened up a "new" business the next day, same employees, different business name. The second one also claimed bankrupcy and did the same thing, only got rid of the employees and continued to trade. The whole time DH worked for him, he promised he would catch up the super, going through a tough spot, blah blah blah. DH went down as a benefactor chasing money for the second boss. It's now been seven years..........and nope, not a cent from either.
He advised the ATO and the bankrupcy people on both occassions on what was going on. Yeah, there's been a really big point to that. So even though it's law to pay it, it's virtually impossible to get it if it hasn't been paid to you.
