thread: Can a landlord say you can't birth in their property?

    Also, I sure hope we can't get in trouble for a homebirth, that's part of the reason I wanted this house! I was looking at all the rooms going "I could give birth here"

    That's an unequivical "NO". As a tenant you are entitled to full and private enjoyment of the property. They cannot say what you can or cannot do in that property, so long as you do not damage it.

    I should point out it is "quiet" enjoyment, not "private" enjoyment, of the property. And whilst they can't say no to you birthing there, you do have to adhere to sound and noise restrictions. I actually have teh standard clauses for this in my new lease, plus a special clause added on by the RE & landlord about how thin the walls of my house are and how I will remain aware of this at all times, etc etc and the repercussions for breaching the clause.
    As mentioned too, you are liable for any damage any leaky birth pools may do

    That's wonderful PZ, that you got the place!

    Pets are common things that landlords often negotiate on.

    HBs are not.

    Maybe in time when we see HBs becoming more the norm, we will see HB clauses in contracts... but ATM, they can't do anything about it, to the best of my knowledge.

    I'd also call the REA a few weeks before birth and say 'hey I'm having a baby in a few week and was wondering if there were any inspections due around that time? If so can we do it now?' then go wild setting the place up after the inspection so youre not worried about them seeing pools and O2

    they COULD argue that birthing often isnt very 'quiet' enjoyment
    But otherwise I can see that they could do anything
