I'm so sorry you are in pain. You cannot insist that a surgeon perform surgery on you however. Did they say to you that you were not dilating yet? It sounds to me from the information you have written that you are in the latent stage of labour and as birth is not imminent it is safer for your baby that you do not yet deliver. However they may be able to offer some more relief for you from the pain and if the pain cannot be relieved then they should be looking at a different plan of care.

My advice would be to go back and ask for a second opinion. Try not to let them send you home unless you are happy with their plan of care. Ensure they are aware that the pain relief you are having is not helping. What is your gestation now? It is true that the earlier the baby is born the more chance that they will have complications, but at the same time 37 weeks is considered term.
