I'm hoping someone can help me out with this debacle
I am currently in the process of recovering money owed to me for remaining annual leave from my employer through the fairwork ombudsman anyway as you can gather its' getting quite nasty etc. The employer a small company have been emailing a few times and have stated i have resigned will this effect if i get paid my parental leave? I haven't actually resigned formally but am happy too cos it's just not a place i would go back to now. Also after speaking to the local Centrelink office girl this morning she stated that once i apply for the paid parental leave and it's been approved my employer gets the lump sum payment then has to disperse the funds to me fortnightly (there payrun). I'm really concerned about this as they are refusing to pay out a little over $1000 that is owing to me so how on earth are they going to pay me my parental leave payment. Is there anyway i can apply to the government with my concerns about all this and have them pay it to me instead? This is a company that can't pay there IAS or BAS statement on time or there yearly business income tax from last year is still being paid back to the ATO as well. I'm concerned that they'll take my money from the government and use it to pay out one of there debts and possibly fold the company up - bankrupt or something and i'll be left with my money being still owed.

Oh how horrible you must be feeling. There is nothing worse than stressing about your PPL. I've had drama's with the PPL (lets not go there) however from what I can gather, there are laws in place for your employer to pay you and serious consequences if they dont. I would be calling Centrelink to see if they can pay it directly to you (possibly explain the situation) cos Im pretty sure they can take the tax out for you too.
Id also be expressing your concerns with the ombudsman as well.

I'm giving the accountant one more chance in the morning to have it sorted or attempt to have it sorted before I lodge the complaint with the fairwork ombudsman. My boss is just being completely unreasonable, I just wonder how another female can do this virtually on the eve of me having this bub. Such a stressful situation ATM.
Apparently family assistance office were allowing it to go through them direct or your employer but have since got it only going through the employer now, I'm just hoping they allow for circumstances like this that they are able to handle it instead.
Call FAO. Explain situation. If the employer deems you to not be an employee you can have FAO make the payments. The consultant you speak to needs to be told you don't want the payment from employer due to these factors. They may need to speak to processing or send a written request for it to be updated for you

BG thankyou so much. I've been so stressed about all this that i've barely slept for two nights and just had a total pregnancy meltdown at 5am in the morning, her emails are getting harassing and i think i'm going to have to get DH to step in today and tell her to back off.
Spoke with FAO this morning and I have put my claim in now just waiting on baby. There is a bit of a loophole that states you don't have to be employed but you do have to meet the work test. Anyway I just ticked the box that says I am no longer employed by them. Thank goodness that's not an issue now and I was so happy with the lady from FAO she was lovely and directed me through the whole process and form online
