the new legislation doesn't take effect until Jan 1 2011 - and doesn't really impact the father at all (unless the mother returns to work when the baby is less than 18 weeks, in which case dad may get a few weeks paid to be at home as primary carer). all exisiting legislation is in place and will be what impacts his entitlements for this year, so he will only be entitled to paid leave if it is part of his agreement or award. as a general understanding, permanent staff would get two weeks of leave (not necessarily paid unless they have acrued annual leave which they can use). it is a very murky area and he needs to speak to his employer about his entitlements under his current employment terms
