my cousins ex doesnt want him to have the kids over christmas/new years even though its in the court order..
he has just spent 10k getting the court orders sorted so every one was happy... she knows he has no more money to spend on fighting her(although she doesnt either)
so was wondering if there was a way to enforce it with out costing him money
He should be able to take it back to court & represent himself, I am pretty sure?
I'm not sure how it works now but when we were going through this years ago I lost my legal aid & ended up representing myself.
It might be worth doing if the orders are new & she's already not complying...
ETA - I think also you can arrange for police assistance. As in, he can turn up there with the police & they will assist him inhaving her comply with the orders, at least that's what we were told but again that was years ago.
I don't know that this would be the best way however, not very nice for the kids & really I think the very last resort.
Since he has some time, he can also go to social services ( they probably already have someone, from the court case etc, that the kids have met and talked to maybe) and let them know that she has said she wont hand them over. They can talk to her beforehand, and be there at hand-over instead of the police.
If she realises he WILL fight to see the kids, she just may back down anyway.
