    Question What can I do here? Will they let me do this???

    We got a call from our RE last week saying that our rent was a week behind, confused because our rent is paid by DD every fortnight we asked for proof that this was the case.
    They are now claiming that the rent that wasn't paid is from 2008 Not sure why they are only just picking this up now...but anyway....

    So I've been to the bank and got a copy of our bank statement from the period they claim the rent wasn't paid for...and if i'm working it out right, yes indeed our rent is a week behind - but like I said - why didn't they pick this up back in 2008....

    I don't mind paying it but there are 2 things here:
    1. They are asking for $360 which is the rent we are paying now, but back when this happened our rent was only $330
    2. I don't have $330/360 laying around spare right now.

    So my question is:
    1. Can they make me pay $360 even though we were only paying $330 at the time of this happening?
    2. Can I negotiate with RE to pay extra each week until it's fixed up (I can pay the extra with the next CCTR)

    This is just stressing me out now.

    I don't think they can, because you would only be behind $330 not $360.. and thats a bit weird that they have only picked up on it now, have you questioned why it wasnt picked up sooner?

    I would talk to the tenancy rental place (as you can see I cannot remember their proper name) and ask for advice on the amount and the time difference.
    Seems a bit strange that it has taken this long to find it.

    You should only be $330 behind if they keep your rental ledger by amounts instead of weeks. I would only be paying $330 and explaining the situation and that you can pay it off over x amount of weeks. Hopefully you have a nice agent who will agree to this, especially as it's taken so long to pick it up. Good luck

    I think you only owe $330 as that was the rent payable at the time it was missed.

    Also you're obviously a relatively long term tenant, therefore given that fact, and the fact that they took sooo long to pick it up, they should have no issues agreeing to a repayment plan over the next couple of months.

    I'd suggest you write an email / letter to the agent stating what you will pay and when; they are more likely to agree if they have it in writing.

    If you've always paid by DD I'd check your bank records and (if necessary) send them a copy to show that you're always up to date.

    It would seem very strange that if you've always paid on the same day by DD then I don't understand how you could have missed a week.

    I'd ask them to prove it before paying anything.

    My realestate entered my rent onto their system wrong twice. one they picked up on but one they didnt. I was lucky i technically never fell behind as i made sure i was still aweek in advance when we paid rent. The RE never picked up on the s2nd lot of rent they entered in wrong. It wasnt until i asked for my tenant ledger that i noticed i wasnt as far in advance as i should have been. So yes it is possible that they can miss this.

    You should only have to pay the $330 which is what the rent was when it was missed. They should atleast give you some extra time to gather this money together(like they would if you have a rent increase and have to pay extra towards the bond)

    We had the same thing happen. A week behind since almost a year ago. They told us at the time and I wasn't sure that I paid it but thought I must have as they didn't say anything again. Then they sent us a remedy to breech thing saying it was behind.

    No I don't think they can ask you to pay your current rent. They can only ask you to be paid up to where you need to be paid up to (current, or a week or fortnight in advance). So really you'd only be $330 behind where you should be, if you haven't missed anything else.

    I'd give them a call and apologise, say that this was totally unexpected and you don't have an extra $330 laying around so can you please pay off a little bit over a few weeks.
