    Angry Can they do this?

    Can they make my DP do something that isn't part of his job description?

    DP is the assistant fine wine manager at our store but has learnt that he has to do some register shifts as another manager is under the impression our store manager doesn't think he works hard enough.

    We are angry/upset because DP stepped down from Service manager because he didn't want to work on registers or be a part of that he wants to work in fine wine and extend his knowledge in wine.

    DP is now going to call our area manager and the fine wine specialist and request to move stores which means i have to cut hours at work so we lose money which right now we can't afford.

    If it is in his contract that he might be asked to work in other areas, then yes they can. Sometimes it can actually look good to be willing to help out in other areas.

    Hun that sucks that they are pushing him into something he doesn't want to do!

    You'll need to check his employment agreement/contract: that will stipulate what he is and isn't expected to do. If the contract doesn't state anything about working registers, then he could stand his ground and say no, he isn't going to do that.

    But I'd hazard a guess that there'll be a clause in there saying something about covering "other duties" when required. It seems fairly logical that a retail store would cover their bases like that in case there is a time when maybe there are two people working wines and the registers are flat out, so he can be called over to registers to assist. Or something similar.

    Another thing he could do is get in touch with the union - I'm guessing you guys would be covered under the SDA - Shop, Distributive and Allied Employees Association. Is he a member? They would be able to advise him what his rights are.

    Changing to another store might not help... start with his contract and go from there.

    On another note: why does him changing stores impact you? Don't quite understand sorry...

    Your post is a little bit vague LMS. You shouldn't make rash decisions on "someone else thinking that someone is under the impression..."

    Most people have clauses in their contracts which say that they will be required to perform other tasks if necessary. Perhaps it's a case of everyone needing to pitch in and help out on the shop floor. There's nothing like working in a place where everyone is happy to muck in and help out to get the place running smoothly.

    DP is happy to work the occasional time on registers but to say he doesn't work hard enough and moving him to another dept to work. No other fine wine manager has ever been asked to do that. OUr store is hiring 2 more register staff so there really is no need for him to be on registers at all.

    They had already asked him to move to another store as they desperately need a fine wine assistant manager so moving wont be an issue just means that i won't be able to work much or if at all. We work together because its easier when he finishes i start, i work his days off and it works well with the store needs. But if he moves then i wont be able to work the shifts i have, they don't have much room to move things around for me.

    Just checked your agreement on the SDA website, clause 36 basically says they can ask any employee to do anything "within their skill range". So they are within their rights.

    BUT - saying he is "not working hard enough" is not really ok. He needs to sit down with them and formally document their complaints with his work ethic and also a plan to correct this. They can't just go flinging around accusations like that.

    If he wants to move though then he should move (and it sounds like he was already looking before this happened). I'm sure you guys can work around each other again. Might not be as easy when he's at a different store but if they want him badly enough maybe he can dictate his shifts so that you don't need to change yours.
