    Tennent rights

    Ok, so the place i rent is being sold. And it is driving me nuts. We only found out because the person selling it called us to come look inside. then she called this morning at 830 to see if a building inspector could come see it today! she was hoping we wouldn't answer so she could just do it! We told her no. she asked for mon and I said no because we won't be home after the photographer that came through we're not having anyone here unless we're here. She then gave the company our SILENT phone number without permission to call me direct. She also told me the inspection would take 15 min... try an hour! So I've organised that.

    Then, late today guys turn up and start laying mulch in our yard!!!!! No warning, no phone call, nothing! Is this allowed?! Then the guy knocks on the door and tells me they want to come back tomorrow to high pressure clean the court yard tiles! WTF? Where is the notice? ANd they'll use water we have to pay for! (Small quibble but it is the principle). Is this kosher? Does anyone know? Does the 24hrs written notice to enter a premises include the yard or just the house?

    It all sounds really disorganised and rude to me. It's been too long since I've rented, so I can't remember the laws, but hopefully someone else will be able to give you a clue. Having BTDT twice before, I have every sympathy, it is such a PITA when your rental is being sold......at least our owners told us they were doing it!!!!!

    yeah you are meant to get written notice and 24 hours notice.

    I'd look up the tenant's rights act in your state and give them a call! I think it doesn't seem right!

    Are you renting through an agent or directly through the owner? do you have a signed lease?

    through an agent with a signed lease. I have checked the Victorian Tennents Association and it says they have to give 24hrs written noticed to enter the premesises but not sure if it is just the house or the yard as well?

    Property/premises means the WHOLE area you are renting. Which means your yard is your private property, and they HAVE to give notice to enter. You can refuse, and you can ring your RTA and issue a Notice of Breech (or Breech something... basically jsut tells them they are wrong and you know it).

    thanks guys. i am going to keep a diary. dh is ringing property manager tomorrow. if he doesn't then I will and I won't be anywhere near as nice as he will. I am so peeved off about it.

    definitely includes the yard, you are renting the whole property snd are responsible for the yard so therefore get the rights to the yard too iykwim. Stand up for yourself they definitely cant do that!!

    Yeah, I'd be contacting the RE. I've lived in 3 places while they were sold. We'd get 24 hours notice of people wanting to look through, never had the owners themselves come through. Never had others coming in to do things with out notice either.
    Last year our place was sold purely as an investment property & the owner (also property manager) came through for pics, than arranged for the pest dude & inspesctor to come at the same time so we didn't have to deal with them twice

    Rights and Obligations -Victoria

    There are rules about when a landlord or agent is allowed to enter a rented property. As a tenant you are entitled to enjoy peace and quiet in the property you rent and you must allow your neighbours peace and quiet in their properties.


    A landlord or agent can enter your property, as long as you have been consulted not more than seven days in advance and have agreed on the time. Landlords can also enter on 24-hour written notice to:
    • Carry out duties such as repairs and maintenance
    • Have the property valued
    • Show the property to prospective buyers or lenders
    • Verify a reasonable belief that you have not met your duties as a tenant
    • Make one general inspection in any six-month period, but not within the first three months of the tenancy
    The written notice must also be posted or hand delivered between the hours of 8.00am and 6.00pm. Landlords can also enter the property when you are not present, providing they abide by the rules regarding written notices. They must also take responsibility for the actions of anyone they authorise to enter the property.


    However, regardless of agreed times and 24 hour a written notice, landlords do not have the right to:
    • Enter in an unreasonable way
    • Stay any longer than necessary to do what is required, unless you have given permission

    Guess which little ducky is on the war path?! I just found out the guy doing all the gardening is THE OWNER!!!!!!!!!!!!!!!!!!!!!! I just went and had a friendly chat with him and reminded him they are suppose to give 24hrs notice before entering premesis and he claimed it didn't even occur to him to contact us! Ooooooooooooooooo so writing that in the log!!!!!!!!!

    Ooooh I forgot to reply to this thread, they are very much doing the wrong thing by far!! Firstly they need to give notice & secondly they need to advise if its the owner doing the work!!! If there are inspections & pics being taken, well that should all be done by the agent. Who do they think they are!!!! WTF didn't occur to him!!!!
    I would ring the property manager right now.
