    Change of agent mid lease - what happens to bond?

    Wonder if anyone can help - we're currently 2 weeks into a 90 day termination notice on our property and the owner has changed realtors. She wants to sell the house and has decided to go with a different agent in town.

    My question is - what happens to our bond? Do I need to do anything with the bond board (or whatever they're called) to tell them we're now with a new agent? Will I have to pay a new bond to the new agent and claim my bond back from the original agents?

    I haven't got a clue about this and can't get to speak to the new agent until next week - the old agent won't talk to me at all.

    Just because she's selling with a new agent doesn't mean your lease has to go to the new agent too. To change a lease to a new agency you would have to sign a whole new one, which would mean getting your bond back from the old agency and paying it again with a new lease. You can sell with one agent and lease thru another, I've done it as a landlord before.

    Isn't the bond held independently with the rental tenancies agency? So it's independent of any real estate agent - so a change of agent should not make any difference. So the amount that you pay in bond, gets deposited with the rental tenancies people and then withdrawn to refund to you if you leave the rental. At least that's my understanding, might be different state to state though.

    It doesn't make any difference to you or your bond
    Had this happen a few years ago & had our current RE bought out by another company.
    If there are any changes you'll be notified in writing, but thats more in regards to any changes to where your rent payments would be made.

    Thanks for your reply.

    The email I got this afternoon says "Please be advised that (Agent A) are no longer Managing Agents for the above premises. (Agent B) have been appointed as the new Managing Agent by the owner.

    Please do not pay any more rent to our office. All future payments should be forwarded to (Agent B) by payment method as they will advise you. "

    We're not actually in a lease period at the moment - it expired in November - and I'm really confused by it all.

    Thats all you need to worry about then. Some agents will do things differently, like inspections (some every 3 months like clock work, others not so much), but be assured that anything there is to worry about will be forwarded to you in some way.
    I've changed the accounts my rent payments go to & thats it. I've not been under a lease agreement since December 09.

    Thanks Just need to find somewhere else to live now! It's a relief that I don't have to find the money for another bond while trying to get the bond money together for a new property.

    Here's some info about bonds and tenants in NSW - it is deposited with fair trading. Have a read, it should answer your questions.
