    Can a bank do this????

    I made a payment via internet banking into an account with the wrong BSB. ANZ sent a dispute to NAB (where it went accidentally) and the response has come back that the dispute was unsuccessful. End of. No explanation, just sorry, you're money is gone.

    Is this legal/allowed??? Fuming!

    That's weird? Whenever it's happened to me the money bounces back to my account? Usually takes about 5 days though to process.

    Thats the thing, I found out the BSB was wrong, so went straight to ANZ when I realised it never bounced back. So they did a manual dispute and they wont give it back!!!!! INSERT LOTS OF SWEARWORDS! They told me to seek legal advice if I want to take it further, but what a joke, its less than a lawyer's fees will be. NAB have refused to reverse. GRRRRR.

    no it's not right.

    You can get the money back, I would dispute it again. They can't just take your money. I worked for a bank and we always reversed the transaction if someone sent money into a wrong account, the receiving bank usually does the reversal, not your bank.

    I doubt it's legal! Keep fighting Kelly, you WILL get your money back. Banks are so dodgy and so quick to take your money.

    I was charged an overdraw fee from a bank for a misunderstanding with PayPal. I asked for it back when I explained what happened, my request was denied so I kept persisting and they eventually gave me my money back. They shouldn't be able to keep your money just because it's held in their bank!!

    I thought (and if I get a chance can look into it tomorrow at work - I work in a bank - but not those 2 mentioned though) - that if its gone into someones account they would have to wait for that persons authorisation to debit it back out to reverse it back to you. I vaguely remember this happening a few years ago to one of our client's (though I wasn't involved in the case - just heard all about it through my collegues) and it seemed to take forever for that person to give the money back - I'm fairly sure it ended up being resolved - but it was a few months (thats why I kinda remember it cause it just went on and on forever).

    Is the case actually closed? Or are they waiting for the person to respond?

    If its not a valid account number then it should have automatically bounced back to you I would've thought...so I'm assuming it must've been someones account. I also thought that when you put the person/account name in the transfer it had to match the account number it was crediting (though I'm 100% sure on this - but I'm sure I've had clients get account names wrong and the money was returned - usually they've put a nickname instead of the proper name) - but I've only just returned back from too much time away - so sorry I can't be definite on this.

    I would dispute it again as I'm sure you intend to. Call and speak to the internet banking section (as apposed to the branch) as they usually understand the internet banking system that little bit better (usually anyway so I have found).

    I'm surprised it didn't bounce back - you must've fluked sending it to a completely different persons account. You'd think THEY would lodge an enquiry when they got extra money...at least, I would I'd ring NAB direct and try it out for yourself, using the magic word 'Ombudsman'. NAB will get fined if it goes to the Ombudsman, so it should hopefully scare them into doing the right thing...

    No thats not right. Ive sent the money to the wrong accounts before (always like 1 or 2 numbers wrong) and I always get it back. THOUGH I get charged $2.50 for my stuff up. Yeah give the Ombudsman a call.

    Hi Kelly, unfortunately I have seen this before. NAB should have received your payment and had no where to allocate it and sent it back to ANZ. As it doesn't appear this has happened, it's probably safe to assume NAB have allocated the payment to one of their account holders and that's why you are hitting a brick wall. I would do 2 things. 1) Go back to ANZ and have them lodge another dispute and 2) contact NAB directly. Explain the problem and find out what the process for disputes is from their end. That way you will know how ANZ and NAB are handling it and hopefully be able to sort it out. Good Luck!

    I'm sure even the threat of this would get some action. Just make sure you get the name and contact details of the person you're dealing at ANZ with first before mentioning. Once they realise that it will be their details you'll be passing on to the ombudsman to contact, I'll bet you at the very least get some proper information.

    yup!! Ombudsman is the magic word if they won't help!!!

    They have to give your money back, and they will see the account name does not match what you put in so it should have been rejected anyways.

    Contact the ombudsman and get a reference number. Call NAB and tell them you want to talk to someone with regard to a complaint you've made to the ombudsman. Offering a number shows you're serious about pursuing it.

    Yep will do. Hopefully I get some answers soon, i have never heard of this happening before.... But apparently the bank account owner who it went to is not responding to contact from the NAB.
